OS 3.1.0 - Is this a bug?

I have not managed to re-produce it all the time, but sometimes when I come out of a Quick Split / Layer (being in Program mode) the polarity of the Hold button is reversed. I.e. The button is lit but it doesn't hold but if I switch it off it holds again. If I move to another program and go back to the previou program it works fine.
I know there are users frustrated with OS 3.1.0 I am starting to understand why.

Has anyone managed to see this behaviour? Is it normal? If not I go back to 3.0.4.
