As some of the other folks have pointed out, the concept of contributary negligence is one of the first things to be determined in a personal injury case. It's quite clear that if the plaintif is aware of the danger but proceeds to continue action that leads to harm, then the defendant is not at fault and the plaintif is denied recourse.

Why make threats you can't make come true? It only aggravates the other party and may make them dig in their heels.
